The act of 187/2022 which amends the act of 171/1993 Z.z. on the Police force as amended will be in force on 01.07.2022.

As part of the amendment to the said Act, new provisions were inserted as follows:

§69i par. 6 second sentenceThe air carrier shall be obliged to send the a passenger name record within the scope of data according to Annex No. 4 letter (a) to (g) at the time of arrival or departure at the external border; the air carrier shall be obliged to delete this passenger record within 24 hours after the landing of the flight. "

§ 69o par. 2) An air carrier that violates the obligation to send a passenger name record in the range according to Annex no. 4 letter a) to g) and in accordance with § 69i par. 6, the Passenger Information Unit of the Bureau of the International Police Cooperation shall impose a fine on them in the amount of between EUR 3,000 and EUR 5,000.

Air carrier means any natural or legal person whose occupation it is to provide passenger transport by air.

The records according to Annex no. 4, letter a) to g) (labeled as “API data” after this point) are as follows:

  1. Full name and surname, gender, date of birth and nationality of the passenger

  2. The ID number and the type of travel document of ID document, with which the passenger identified themselves, which contains the date on which it was issued and expiry date

  3. Date, time and place of departure and date, place and time of arrival, including the flight number and the name of air carrier

  4. The number and names of other passengers, contained within a single localized passenger name record

  5. The entire route for the specific passenger name record, including the airport of the first departure and the airport of last destination.

  6. Total number of passenger

Data about the common flight codes

Based on the stated provisions, in the event of failure to provide API data to the extent and quality specified above, the PIU SK is required to impose a fine in the amount between 3.000 and 5.000 EUR on the air carrier for each data set in each passenger in each flight in which the air carrier failed to comply with that obligation.

Violating the obligations set by provision § 69 par. 2) is understood as:

  • not delivering any API data from an extra Schengen flight,

  • delivering incomplete API data from an extra Schengen flight, or

  • delivering incorrect API data from an extra Schengen flight.

If the air carrier does not have any automatic technical solution for collection and transmission of API data nor any other subject or provider, air carrier can send API data via secured web portal manually. Provider of web portal is Ministry of Interior of the Slovak republic.
